Fairmont man gets prison term for cocaine distribution

Stubbs also charged with running over officer with ATV

FAIRMONT A Fairmont man charged last fall with running over a city police officer with an all-terrain vehicle will now serve a 12-year, seven-month sentence in a federal prison for distributing cocaine, a federal prosecutor said.

Darrell Dee Stubbs II, 31, pleaded guilty in March to one count of an indictment charging him with distributing cocaine in May 2007 in Fairmont, U.S. Attorney Sharon L. Potter said.

Stubbs was sentenced Friday by U.S. District Chief Judge Irene M. Keeley to 151-months imprisonment and three years on supervised release.

Stubbs was arrested last Oct. 16 by city police after he allegedly ran over Officer John Miller with a four-wheeler at Windmill Park.

Both of Miller’s legs were broken. Miller, 34, spent four months in hospitals and rehabilitation centers. In May, Miller said he was still receiving therapy three times a week. He also may have to have yet another operation on one of his legs.

But, Miller also said he hopes to return to duty, possibly in the fall.

Marion Prosecutor Patrick N. Wilson has said he will prosecute Stubbs on a pending state charge of felony malicious assault on a police officer.

In a separate case, the judge sentenced Brittany Butcher, 20, formerly of Fairmont, to three years in prison and three years on supervised release.

Butcher pleaded guilty in March to one count of using her home in Fairmont as a crack cocaine house from last September through Jan. 8, 2008.
