Two Marion County fugitives were taken into custody in Fergus County, Mont., Friday following a tip from the Mountain State Fugitive Task Force.
A regional unit made up officers from local law enforcement agencies, the Mountain State Task Force received a lead on the whereabouts of Fairmont residents George Wesley “Chuck” Nay and Kimberly Janne, which led to their arrest in Montana.
Nay is wanted on three counts of second-degree sexual assault for allegedly sexually assaulting a juvenile on three separate incidents between September and January of 2007 at a Fairmont residence.
Janne is wanted on child neglect charges for her alleged involvement in the same incidents. As the mother of the juvenile, Janne is charged for allowing her daughter to be alone with Nay after learning of the incidents.
A deputy with the task force said the suspects were taken into custody Friday morning in Fergus County and a Marion County prosecutor has approved their extradition back to West Virginia. They have the option to either waive the extradition or to fight it and request a hearing, and will remain in Montana until that is decided.
