Third Taylor murder trial set

Scheduled to be held in January despite motion filed by defense

FAIRMONT — Despite a State Supreme Court motion filed by the defense earlier this week, the third Lincoln Taylor murder trial has been rescheduled in Marion County Circuit Court for late January.

Jackson County Assistant Prosecutor Dan Dotson, who is serving as the special prosecutor in the case following the resignation of Marion Prosecutor Pat Wilson from the case in June, confirmed Wednesday afternoon that the trial has been set for the weeks of Jan. 18 and Jan. 25, 2010.

He said these dates were determined in a conference call Wednesday between him, Taylor’s defense attorney Martin Sheehan and Janes’ secretary.

Taylor, a 25-year-old Huttonsville native, stands accused of first-degree murder for pulling the trigger that killed 22-year-old Derrick “Lil’ D” Osborne on Memorial Day 2007.

He has been tried twice in Marion County, with the first ending in a mistrial after four days because of jury misconduct and the second resulting in a hung jury on the murder charge and an acquittal on a charge of conspiracy.
