Keener defendant wants truck back

FAIRMONT For nearly two years, the Fairmont Police Department has been combing the vehicle that allegedly hit and killed 21-year-old Erin Keener in 2005 for evidence.

And now, the owner of the truck, and the man charged in the incident, is trying to get it back. In June, 65-year-old Jon D. Morris was charged with leaving the scene of an accident with death in the incident, which occurred in November of 2005 outside of Vincent’s club on Merchant Street.

And Friday, in addition to several other motions, Morris’ defense attorney, James Zimarowski, argued a motion before Marion Judge Fred L. Fox II to return his client’s truck because it is “exculpatory evidence” in the case.
