Hearing in Taylor case set for Jan. 13

Just five days before scheduled trial date in Fairmont murder case

FAIRMONT Just five days before Lincoln Taylor is set to go to trial for the third time in Marion County Circuit Court in January, the state Supreme Court of Appeals will hear arguments to determine significant details of the case.

Jennifer Bundy, public information officer for the West Virginia Supreme Court of Appeals, said this week that a hearing has been scheduled for the first-degree murder case, which has become high-profile on a local level since the alleged 2007 shooting, on Jan. 13. Officials say this likely will push back Taylor’s Jan. 18 trial date.

A 25-year-old Huttonsville native, Taylor stands accused of shooting and killing 22-year-old Derrick “Lil’ D” Osborne on Memorial Day 2007. He has been tried twice in Marion County, with the first trial ending in a mistrial after four days because of jury misconduct and the second returning a hung jury on the murder charge and an acquittal on a charge of conspiracy.
