Drug investigation leads to indictment

Among 26 on first day of grand jury

FAIRMONT — Twenty-six people were indicted by a Marion County grand jury Tuesday.

Eric D. Wise, 49, of 700 1/2 Gaston Ave., Fairmont, was indicted for possession with intent to deliver a controlled substance, delivery of a controlled substance and conspiracy to commit a felony.

According to criminal complaints, sheriff’s deputies executed a search warrant at Wise’s residence in August as part of an ongoing drug investigation. Deputies had previously used a confidential informant to allegedly purchase oxycodone pills from Wise in a controlled buy with audio and visual surveillance.

When executing the search warrant, deputies reportedly discovered a number of oxycodone pills as well as packaging material and U.S. currency.

Robert Austin, 42, of 515 Gaston Ave., apartment 3, was indicted for possession of a controlled substance with intent to deliver and conspiracy to commit a felony.

Austin, who was at Wise's residence, allegedly had more than 300 oxycodone pills on his person and more than $1,000 in U.S. currency. He told deputies he sold the pills for $37-$40 each, the complaint said.

An indictment is only a charge. It is not proof or evidence of guilt. The indictments included:

• Larry Howard Layman, 64, of Fairmont, for possession of a controlled substance with intent to deliver and conspiracy to commit a felony.

• Jeb Michael Jones, 24, of Fairmont, for breaking and entering and petit larceny.

• Eric Michael Walker, 34, of Morgantown, for third or subsequent offense DUI and third or subsequent offense driving while license suspended or revoked for DUI.

• Mark Alan Huey, 52, of Rachel, for malicious assault, battery and daytime burglary.

• Joshua Allen Baker, 29, of Fairmont, for possession with intent to deliver a controlled substance (cocaine), possession with intent to deliver a controlled substance (marijuana), conspiracy to commit a felony and fleeing from officer (other than use of vehicle).

• Carmen Elizabeth Todd, 20, of Fairmont, for unlawful wounding.

• Mark Lee Ashley, 28, of Fairmont, for burglary and second offense domestic battery.

• Todd Christopher Cottrill, 29, of Fairmont, for possession of a controlled substance with intent to deliver.

• James Lee Chandler, 29, of Clarksburg, for third or subsequent offense driving on suspended or revoked for DUI and possession of a controlled substance with intent to deliver.

• Christina Burton-Osborne, 30, of Rivesville, for grand larceny.

• Brian Lynn Nutter, 32, of Clarksburg, for fleeing in a vehicle while DUI, fleeing in a vehicle in reckless indifference to safety of others, fleeing from an officer (other than a vehicle) and first offense DUI.

• Shane Allen Hickman, 24, of Shinnston, for third or subsequent offense DUI and driving on a suspended or revoked for DUI - first offense.

• James Opha Grogg, 27, of Fairmont, for delivery of a controlled substance and possession of a controlled substance with intent to deliver.

• Danny Ray Sisler Jr., 34, of Fairmont, for robbery in the second degree, obtaining a controlled substance by misrepresentation, fraud, forgery and deception or subterfuge, and impersonation of a law-enforcement officer.

• Mark Anthony Stemple, 37, of Fairmont, for unlawful assault.

• Johnny Eugene Perrine, 39, of Fairmont, for possession of a controlled substance with intent to deliver.

• Cecil Vernon Woodring, 45, of Fairmont, for third or subsequent offense DUI and driving on suspended or revoked for DUI - first offense.

• Jason Harold Jones, 32, of Worthington, for breaking and entering, attempted burglary and conspiracy to commit a felony.

• James William Hinerman, Jr., 39, of Worthington, for breaking and entering, attempted burglary and conspiracy to commit a felony.

• Christopher Thomas Miller, 34, of Kingmont, for child neglect creating risk of injury, domestic battery and brandishing.

• Jeffrey Lynn Craig, 48, of Fairmont, for manufacturing a controlled substance and felon in possession of a firearm (felony).

• Brandon Michael Wise, 26, of Fairmont, for possession of a controlled substance with intent to deliver (two counts).

• Harold Marcellus Jackson, 40, of Detroit, Mich., for possession of a controlled substance with intent to deliver (three counts).

• Charles E. Dray, 36, of Mannington, for wanton endangerment, DOP (misdemeanor), obstructing an officer and assault on an officer.
