Stephen Sean Murphy, the Morgantown attorney charged with felony malicious assault after allegedly attacking another attorney in January at the Marion County Courthouse, has lost his bid to have his case dismissed.
After a lengthy preliminary hearing Thursday afternoon, Marion County Magistrate Hank Middlemas deemed there was probable cause that Murphy had committed the offense, and forwarded the case to the grand jury.
That attack sent fellow Morgantown attorney Scott Radman to Ruby Memorial Hospital with several broken facial bones.
Defense attorney Paul Harris of Wheeling said no one had seen the fight from start to finish, so it was impossible to tell who started it or if Murphy had been the aggressor.
Special prosecutor Michael Parker of Randolph County countered with testimony from Marion County sheriff’s deputies and Murphy himself that the attack had taken place, had caused Radman’s injuries and Murphy was involved.
