Amanda Jo “Mandy” Barker, former freshman cheerleading coach at North Marion High School, waived the right to a preliminary hearing Wednesday, opting to have it at a later date.
Marion County Prosecutor Pat Wilson said when someone is arrested on a felony charge she is entitled to a preliminary hearing, which is an opportunity for the defendant to require the state to demonstrate probable cause that a crime was committed and that the defendant committed it.
In this case, the state will have to demonstrate why it believes it can prove that Barker, 31, sexually abused two male students, ages 17 and 16, on multiple occasions in the first half of 2012.
Wilson said the law required that Barker be offered a preliminary hearing within 20 days of her arrest. The defense asked to continue the hearing, meaning it will be rescheduled for a later date.
