In 1983, Phillip Reese Bush was found guilty of the felony murders of Kathleen Jane Williams and Charles Dale Goff in Fairmont.
Because of pretrial publicity, that trial had been moved to Wheeling in Ohio County.
On Feb. 15, 2013, Ohio County Circuit Court Judge James P. Mazzone granted Bush’s petition for writ of habeas corpus.
This set aside those 1983 murder convictions based on “ineffective representation of counsel” and awarded him a new trial.
The state has appealed that reversal. The matter is now before the West Virginia Supreme Court of Appeals.
