Morgantown attorney to stand trial in November

Special prosecutor appointed to case for man indicted for assault of fellow attorney

FAIRMONT — Stephen Sean Murphy, the Morgantown attorney indicted on one count of felony malicious assault of another attorney at the Marion County Courthouse in January, will stand trial in November.

At his arraignment Tuesday, Murphy was scheduled for trial Nov. 6-8 by Judge Christopher C. Wilkes of Berkeley County, the 23rd Judicial Court of West Virginia.

Both Marion County circuit judges, David R. Janes and Michael Aloi, and Marion County Prosecuting Attorney Patrick Wilson have recused themselves from the trial.

Special prosecutor Michael Parker of Elkins is representing the state. Paul Harris of Wheeling is defending Murphy.
