Commission files appeal in Humphreys case

Elliott, Tennant file separate civil suit against former county employee

FAIRMONT — The legal battle wages on between a former employee and the Marion County Commission.

The two latest strikes come from the commission this time, as well as two sitting commissioners, regarding a civil suit filed by former county human resources director Rick Humphreys.

On Nov. 26, the commission filed an appeal with the West Virginia Supreme Court over a September judgement in Humphreys’ favor that awarded him past and future wages lost when his position was eliminated on Dec. 31, 2009, and he was not given a position of equal or lesser compensation within the county.

And on Wednesday, commissioners Randy Elliott and Burley “Butch” Tennant filed a civil suit against Humphreys claiming malicious prosecution and intentional or reckless infliction of emotional distress.

Marion County Administrator Kris Cinalli stressed that the two cases were separate, though they had been filed within a two-week period.
