FAIRMONT — A 41-year-old Fairmont man is being held in the North Central Regional Jail in lieu of $500,012 bail charged with sexually assaulting a woman Aug. 26 in Marion County.

The Marion County Sheriff’s Office charged Ernest Ray Agustin, of 321 Reubens Run Rd., Fairmont, with two counts of second-degree sexual assault, a felony. According to the court papers, Agustin forced the victim to have sex against her will.

The victim told police that Agustin shoved her to the floor and “then covered her mouth and nostrils until she couldn’t breathe.”

According to police, he yelled “die, die, die” at her while he accused her of cheating and “held a barbell over her head as he threatened to strike her with it, if she refused to confess.”

The victim said Agustin continued to hit her in the stomach and head, according to the complaint.

The court papers state that he sodomized and raped her.
